General Terms and Conditions of Sale for Abyss Climbing Products

Article 1 - Purpose These conditions apply to sales made by Abyss Climbing (located at 348 route de Sèvres Anxaumont, 86800 Savigny-Lévescault), specialized in manufacturing climbing training equipment.

Article 2 - Prices Product prices are indicated in euros, including all taxes (VAT and other taxes applicable on the order date), unless otherwise stated, and excluding processing and delivery fees.

For any order outside metropolitan France, you are the importer of the concerned products. Customs duties or other local taxes may be required. These costs are your responsibility. We advise you to check with your local authorities about these aspects.

All orders are paid in euros.

Abyss Climbing reserves the right to adjust prices at any time, but billing will be based on prices in effect at the time of order confirmation, subject to product availability.

Products remain the property of Abyss Climbing until fully paid. However, upon physical receipt of products, the risks of loss or damage transfer to the buyer.

Article 3 - Orders Orders can be placed on our website: www.abyssclimbing.com. Abyss Climbing reserves the right to refuse any payment or not confirm an order, particularly in case of supply issues or difficulties concerning the order.

Article 4 - Order Validation Any order placed on www.abyssclimbing.com implies full acceptance of these General Terms and Conditions of Sale. Order confirmation will validate the operations performed.

An order summary and these conditions will be sent to you by email.

Article 5 - Payment Order payment must be made by credit card via the secure Stripe system.

Article 6 - Right of Withdrawal In accordance with Article L.121-21 of the Consumer Code, you have 14 days from product reception to exercise your right of withdrawal, without justification or penalties. Products must be returned in their original condition, with all accessories and packaging. Return shipping costs are at your expense.

If the right of withdrawal is exercised, Abyss Climbing will process the refund within 14 days, using the same payment method used for the order.

Exceptions to the Right of Withdrawal The right of withdrawal does not apply to products that are:

  • Made to measure or personalized

  • Fully executed before the end of the withdrawal period with prior consumer consent

  • Whose price depends on financial market fluctuations

  • Which expire quickly or have been opened by the consumer for hygiene or health reasons

Article 7 - Availability Products are available while visible on the site, subject to stock. If a product becomes unavailable after ordering, you will be informed by email and the order will be canceled without bank charge.

Abyss Climbing also reserves the right to limit the quantity of items ordered per customer.

Article 8 - Delivery Products are delivered to the address provided during ordering. In case of delay, you will be informed by email. According to law, in case of excessive delay, you may cancel your order.

Abyss Climbing is not responsible for delivery delays due to customer unavailability after several delivery attempts.

Article 9 - Warranty Claims, exchange requests, or refunds must be made by email within 30 days following delivery. Returned products must be in their original condition.

Article 10 - Liability Products sold comply with French legislation. Abyss Climbing cannot be held responsible for non-compliance with destination country laws.

Abyss Climbing cannot be held liable for product misuse.

Article 11 - Applicable Law and Disputes This contract is subject to French legislation, regardless of the buyer's residence or nationality. Thus, all provisions of these General Terms and Conditions of Sale, as well as any disputes that may arise regarding their interpretation, execution, or validity, will be governed by French law.

Article 12 - Intellectual Property All elements of www.abyssclimbing.com remain the exclusive property of Abyss Climbing. No reproduction, exploitation, or distribution of site elements is authorized without prior company agreement.
